Terms and Conditions – Web Design & Development Services

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (the “Client”) and jobjoseph.com, operated by Job Joseph (the “Company”). By engaging the Company’s services, you confirm that you have read, understood, and agreed to these Terms.
1. Scope of Services
The Company shall provide web design, web development, and related digital services as outlined in the mutually agreed proposal, quotation, or contract. Any services requested beyond the agreed scope shall be treated as additional work and billed separately at the Company’s prevailing rates.
2. Client Responsibilities
a. Timely Provision of Content
The Client is responsible for providing all required materials, including but not limited to text, images, logos, and branding assets, within the agreed timelines. Delays in content submission may affect project schedules.
b. Review and Approvals
The Client agrees to review deliverables and provide approvals or feedback promptly to ensure timely project completion.
c. Ownership and Rights of Materials
The Client represents and warrants that they own or have legal permission to use all materials supplied to the Company. The Client agrees to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from the use of such materials.
3. Project Timelines
The Company will use reasonable efforts to meet agreed timelines. However, delivery dates may be extended by approximately 4–5 business days due to unforeseen circumstances. Any delays caused by the Client, including late submissions or approvals, will result in corresponding adjustments to the project timeline.
4. Revisions
The project includes up to two (2) major revisions, provided they remain within the original scope of work. Additional revisions or scope changes will incur extra charges based on the Company’s standard rates.
5. Payments
a. Advance Payment
A 50% advance payment is required before commencement of work. This advance is non-refundable.
b. Final Payment
The remaining balance must be paid in full before the website is launched or project files are handed over.
6. Payment Methods
The Company accepts payments via Razorpay (Razorpay Software Limited), Direct Bank Transfer, and UPI. By using these payment methods, the Client agrees to the terms and conditions of the respective payment service providers. All payments are subject to successful authorization and settlement.
7. Refund Policy
- If the Client cancels the project after design approval but before launch, the Company reserves the right to retain up to 85% of the total project fee based on work completed.
- No refunds will be issued once the website or project has gone live.
8. Ownership and Portfolio Usage
Upon receipt of full payment, ownership of all Client-provided content and approved deliverables shall transfer to the Client. The Company retains the right to display the completed project in its portfolio, website, and marketing materials unless the Client requests otherwise in writing prior to launch.
9. Hosting, Support, and Maintenance
The Company may offer hosting services with an uptime target of 99.95%, subject to a separate hosting agreement. If the Client opts for third-party hosting, the Company is not responsible for compatibility issues or third-party service failures. Ongoing support and maintenance services are available under separate agreements.
10. Limitation of Liability
The Company shall not be liable for delays caused by Client actions or omissions. The Company is not responsible for losses arising from downtime, errors, security breaches, or third-party service failures unless covered under an active maintenance agreement.
11. Cancellation and Termination
A minimum notice period of 30 days is required to cancel hosting, maintenance, or support services. Early termination of annual contracts will require payment of the remaining contract balance.
12. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary, confidential, or sensitive information shared during the course of the project and not to disclose such information to third parties without prior consent.
13. Force Majeure
The Company shall not be held liable for delays or failure to perform services due to circumstances beyond its reasonable control, including natural disasters, technical failures, pandemics, or government actions.
14. Amendments to Terms
The Company reserves the right to modify these Terms at any time. Any updates will be published on jobjoseph.comand shall take effect immediately upon posting.
